The doctoral dissertation by Dr. Nikolaos Zaprianos, titled “Die Rückabwicklung der Verbraucherverträge nach Ausübung des Widerrufsrechts”, has been recently published in Germany by Nomos Verlag.
The book deals with the unwinding of contracts after a consumer’s withdrawal, focusing on the Consumer Rights Directive in relation to the Draft Regulation on a Common European Sales Law. The study is written from the viewpoint of German law, but also takes account of the legal situation in Austria. The main part of the study lays in the investigation of the legal consequences of the withdrawal, the arising restitution obligations in sales and services contracts, the allocation of risk, costs and benefits, the compensation for expenses etc. The author does not limit himself to the unwinding of consumer contracts. He makes fruitful use of his findings, in order to develop a uniform restitution regime for the unwinding of all failed contracts. He thus offers key points of orientation for the future development of Law.
